Via MSNBC. 'Decision re application of the Geneva Convention on prisoners of war to the conflict with Al Qaeda'.

(Memo to President Bush)

"Your earlier determination that the GPW (Geneva Convention on Prisoners of War) does not apply ... substantially reduces the threat of domestic criminal prosecution under the War Crimes Act.... Some of the language in the GPW is undefined (it prohibits for example 'outrages upon personal dignity' and 'inhuman treatment') and it is difficult to predict with confidence what actions might be deemed to constitute violations.

(However) A determination that GPW does not apply... would provide widespread condemnation among our allies... may lead other countries to conclude they are not bound by GPW... could undermine US military culture...

On balance I believe these arguments are unpersuasive..." </i>
